The Court can issue two distinct types of Apprehended Violence Orders (AVOs):

 

  1. Apprehended Domestic Violence Orders (ADVOs): These are AVOs granted to protect someone who has been subjected to or is likely to be subjected to domestic abuse by a family member, spouse or de facto partner, or someone with whom they are in a domestic connection.

Court Process of AVO

Here’s how the court process for an AVO application goes:

 

First return date


The Local Court usually lists the subject one to three weeks following application (depending on how often the Local Court is in session and how busy its courts are). “The initial court date” is the first return date.

 

Hearing Preparations


Parties must follow Local Court Practice Note 2 of 2012: Domestic and Personal Violence Matters to prepare an AVO case for hearing.

The Court will then order the exchange of evidence.

The Practice Note requires the applicant to provide all witness statements supporting their application on a specific deadline (usually two weeks after the mention).

In a police application, the officer will prepare witness testimonies and a summary of the evidence for the defendant.

The defendant must then file a response.

PINOPs must prove they fear future violence, harassment, intimidation, or stalking.

It is unnecessary to show that the protected person fears future domestic abuse if they are under 16 or intellectually disabled. An AVO may also be issued without proof of the PINOP’s fear if the Court finds:

  • The protected person has a history of abuse.
  • The defendant will likely misuse the PINOP again.
  • The injunction protects the victim from further assault.
