How To Get A Divorce in Australia?

To obtain a divorce in Australia, you must have been married for at least two years and separated for at least one year. If you meet these requirements, you are eligible for a divorce in Australia.

You may prepare your divorce petition or contact a Family Lawyers in Brisbane to do it on your behalf.

Family Law Brisbane

In 5 simple stages, we outline how to obtain a divorce in Australia.

Step 1: You must provide evidence of Marriage. Often, this is accomplished with a marriage certificate.

If it is in another language, it must be translated into English; nevertheless, if you do not have a marriage certificate, our family law specialists can assist you in obtaining one.

Step 2: Prepare your online application. You can submit your divorce petition online via the comcourts portal, which will walk you through the necessary questions.

Step 3: Apply online. The next step is to lock your application and pay the filing fee.

Step 4: Inform your ex-spouse. Once you have submitted your application, you must notify your ex-spouse of the divorce procedures.

If your ex-spouse agrees to the divorce and is willing to sign the application, you may create and submit a joint divorce petition.

This means that both parties must sign the divorce petition.

If your ex-spouse does not agree to the divorce or is unaware, you must serve them with the divorce petition.

It must be provided to your ex-spouse at least 28 days before the divorce hearing. If they are overseas, you must allow 42 days for delivery.

Step 5: Check to see if you must appear in court. Depending on the circumstances, you may or may not need to attend court.

If the case is a sole application and minor children are involved, you must appear in court. If otherwise, you will not be required to appear in court anymore.

What Is Sole Custody?

If you have exclusive parental responsibility, you are exempted from consulting the kid’s other parent before making critical choices impacting your child.

This can happen when you provide proof that there are reasonable grounds to suspect that one parent or a person living with that parent has engaged in domestic violence or abused the kid.

Abuse of a kid can extend to another child who was a member of the parent’s family or who resides with the parent.

The court may then consider issuing a sole parental responsibility order.

How Much Will I Get in My Divorce Settlement?

When determining how much each party will get in a divorce settlement, the courts must examine each party’s contributions to the property and future needs.

Courts must evaluate each party’s monetary and non-monetary contributions to the property.

Additionally, they must ensure that the welfare of the family and any children in the relationship are protected.

This is what makes a property settlement during a divorce complicated.

Checking the financial contributions that each party has made can be tedious and time-consuming, but if there is a clear money trail, calculating the dollar value of the donations is straightforward.

There are various difficulties involved in assigning a monetary value to contributions that are not monetary.

In determining the value of a non-financial contribution, the court will estimate the cost of the job as if a third party performed it.

For instance, if you repaired the fence surrounding your marital house, you should estimate how much money was saved and how much the new fence boosted the property’s value.
