What Is An AVO for Harassment?

 

A court-issued AVO for harassment protects an individual against intimidation or abuse by a specified individual.

Standard Apprehended Violence Orders or AVOs prevent the defendant from doing the following to the person who filed for AVO:

  • attacking, 
  • harassing, 
  • threatening, 
  • intimidating, 
  • stalking, or 
  • causing property damage

What Exactly Makes Up Harassment?

An AVO For Harassment Was Filed Against Me, How Do I Defend Myself From It?

 

If you wish to defend an AVO, you must attend a court hearing where the Applicant will explain their case and attempt to persuade the judge to issue an AVO.

You must present evidence to support your argument.

After considering the evidence, the court will either:

  • Create a Final Apprehended Violence Order (AVO) or
  • Dismiss the AVO with no orders.

You can appeal to the District Court if a Final AVO is issued against you. You have 28 days to complete this task.

Another alternative would be to submit a modification request for the AVO.

An AVO is not a felony conviction.

A violation of an AVO is nonetheless a criminal offence.
